The Challenge: Reconstructing a Complex Bid Process in a Major Construction Claim

The mandate required Equinox Construction Services to analyze a major construction cost claim involving a design-build contract carried out during the COVID-19 pandemic and heavily impacted by supply chain disruptions.

‍

One of the main challenges was to retrace the steps taken during the bid process with limited available information. ECS had to review contractual documents, communications, estimates, quantities, drawings, quotes and assumptions to understand how the original bid had been prepared and where risks, opportunities or missed items may have affected the client’s position.

‍

The analysis also required a multidisciplinary understanding of the project, particularly in civil works, excavation and reinforced concrete, while also supporting the review of process, electrical and ventilation-related elements.

‍

Because the project was protected by a Non-Disclosure Agreement, all review work also had to be conducted with strict confidentiality regarding the client, site and situation.

Intervention by Equinox Construction Services

Equinox Construction Services was brought into Genifab’s review team to provide specialized construction expertise and support the preparation of documents for litigation.

ECS reviewed contractual documents, communications, relationships, quotes and contracts. The team also re-estimated various quantities, assessed the accuracy of original estimates and reviewed the relevance of quotes received during the bid process.

Equinox’s contribution focused strongly on civil works, particularly excavation and reinforced concrete. The team also supported analysis related to process, electrical and ventilation domains, helping provide a broader technical understanding of the claim.

By the end of the mandate, ECS contributed to justifying the client’s position in a major construction cost claim through structured review, technical analysis and clear documentation.

“Expert review work requires more than reading documents. It requires understanding how construction decisions were made, what assumptions were used, and how field realities may have affected the outcome.”
